I mostly write FF in my own language, that's why I never had problems with those dumbfucks. I know the pic, ponderosa linked it on her GJ and I have to say that if that was the reason for the banning then 'goodbye fandom and see you at IJ'.

Technically they're within their rights to ban anyone without notice (there's a no obscenity clause in their TOS) but the other banned fanartist had just got a permanent account. I just can't believe that's a coincidence. They'd just got all the money they could expect from her, so goodbye.

I can't agree on that. It would have been in their right to ban IF

1. there had been any offence at all and
2. there had been rules for that kind of offence/banning. Now there are but then there weren't.

Their TOS (XVI, 1) says vulgar and obscene content isn't allowed and (XI) that they can terminate the service at any time, without warning nor refunds for paid accounts. Moreover (XXIII) they can change the rules whenever they please; the burden of finding out what they changed and when they changed it falls on us, not them. In plain words, we're screwed no matter how we look at it.

Screwed, that's right.

The problem is that not any laws but they're the ones who say what is obscene, they even got their own troupers who decide whether or not the piece possessed any artistic merit.

Which means that they're the ones to decide what we're allowed to create and write and see and read.

No - that means they're the ones who decide that lots of paying fandom members will be migrating to nicer places. :p

According to [livejournal.com profile] lysa1, the owner of IJ said no obscene content would be deleted from there without a court order. I'm waiting a bit to see if they'll change their TOS.

Yeah, I heard that, too. Of course he`ll be glad to open his arms to thousands of fandom members (and his pockets too for all the money they bring). GJ on the other hand said they won't have porn over there.

I'm for the option [livejournal.com profile] fandom_flies suggested to open a own mega-archive and blog. But that will cost a lot of money and we'd lose a lot people. Not all are ready to leave LJ.

I'd go with that option if the only thing I had to do was pay for it (no glitches, no obscure html work). Basically I'm a sheep on this - I'll let the others decide and then I'll follow.
